How Chapter 13 can solve your debt problems

Chapter 13 provides bankruptcy protection for consumers who have more debt than they can reasonably be expected to repay. Unlike Chapter 7, which involves a liquidation of certain assets and a quick discharge of debt, Chapter 13 is a reorganization that allows debt to be managed over an extended time period. To qualify for Chapter 13, as of 2020, your secured debt may not be more than $1,257,850 and your unsecured debt may not exceed $419,275.

Here’s how it works. You file for Chapter 13 protection, and immediately the bankruptcy court issues an automatic stay, prohibiting your creditors from contacting you to collect what you owe. The stay remains in effect throughout the Chapter 13 process. You work with an Orange County bankruptcy at my firm to formulate a payment plan based on your monthly disposable income, and submit that plan to the bankruptcy court for approval. Your plan runs anywhere from three to five years.
