Here are a few important facts about the Riverside bankruptcy process:

  • You must qualify — Not everyone can file under Chapter 7. You must qualify by passing the means test, one of two ways. You can show that your household income is below the median income for a household your size in California. If your income exceeds that amount, you can still qualify by showing you have little to no disposable income after allowable expenses.
  • You get immediate relief from creditors — Although the Chapter 7 process takes a couple of months, you get an immediate automatic stay that prohibits your creditors from contacting you to collect the debt. This halts harassing phone calls, threatening letters or repossession efforts during the bankruptcy case.
  • Not all debts are dischargeable — In Chapter 7 bankruptcy you can discharge most forms of unsecured debt, such as credit card balances and medical bills. You generally cannot discharge student loans, back taxes and secured loans. However, there are some exceptions that I can advise you about.
